Terms of Service
These Terms govern your access to and use of the OnCall mobile application, website, Professional Passport, and related services (collectively, the “Service”). By creating an account or using the Service, you agree to these Terms and the Privacy Policy.
1. Eligibility and accounts
You must be at least 18 years old and legally able to enter a binding agreement. Provide accurate information, protect your credentials, and promptly report unauthorized use. You are responsible for activity under your account. OnCall may require identity, email, business, qualification, or payment verification.
2. Marketplace role
OnCall provides technology that helps independent users discover, request, offer, coordinate, document, and review work opportunities. Unless OnCall expressly agrees otherwise in writing, OnCall is not the employer, staffing agency, joint employer, agent, insurer, or representative of a worker or employer and is not a party to the work relationship between users.
Users are responsible for evaluating each other, defining the engagement, determining lawful worker classification, complying with wage-and-hour, tax, licensing, insurance, safety, immigration, background-check, and other requirements, and obtaining any permits or professional authorizations required for the work.
3. Opportunities and bookings
Postings and profiles must be accurate and lawful. A request, recommendation, match, verification indicator, Trust score, Rank, review, or Professional Passport does not guarantee identity, qualifications, safety, availability, performance, legality, or suitability. Users must conduct their own due diligence.
4. Fees and payments
Fees shown before confirmation control the transaction. OnCall may charge a platform fee and additional disclosed fees, including an Emergency Fill fee when applicable. Payment services may be processed by third parties and are subject to their onboarding and compliance requirements. Taxes, withholding, refunds, chargebacks, payment disputes, and reporting may depend on the engagement and applicable law. Beta features may use sandbox transactions only.
5. Attendance and Verified Presence
OnCall may record check-in and check-out time and location with permission to support attendance verification and disputes. Verified Presence indicates that specified evidence met OnCall’s system rules; it is not a guarantee that all work was performed correctly or that every legal requirement was satisfied. Users must review time records and promptly report errors.
6. Professional Passport, Trust, Rank, and reviews
Professional Passport information, Trust, Rank, reliability indicators, and reviews are platform records based on available data and rules. They may be incomplete, disputed, corrected, or changed. Do not misrepresent or manipulate credentials, history, attendance, reviews, or scoring. Public Passport links and QR codes may be viewed by anyone who receives them.
7. Messages and user content
You retain rights in content you submit. You grant OnCall a nonexclusive, worldwide, royalty-free license to host, process, reproduce, display, and transmit that content as necessary to operate, secure, improve, and enforce the Service. You represent that you have the required rights and permissions.
Do not submit unlawful, fraudulent, discriminatory, threatening, harassing, exploitative, infringing, deceptive, malicious, or unsafe content. Do not upload malware, impersonate others, evade safeguards, scrape the Service, interfere with operations, or use another person’s private information without authorization. Report abusive content or users at support@useoncall.com.
8. Safety and emergencies
OnCall does not provide emergency services. If anyone is in immediate danger, call 911 or the appropriate local emergency service. Users are responsible for workplace safety, supervision, equipment, training, and incident reporting.
9. Suspension and termination
You may pause your account or request deletion through the app. OnCall may restrict, suspend, or terminate access when reasonably necessary to protect users, investigate violations, comply with law, address nonpayment, or protect the Service. Records may be retained as described in the Privacy Policy.
10. Service availability and disclaimers
To the maximum extent permitted by law, the Service is provided “as is” and “as available.” OnCall does not guarantee uninterrupted availability, matches, earnings, hiring, payment timing, user conduct, or results. Nothing in these Terms excludes warranties or rights that cannot legally be excluded.
11. Limitation of liability
To the maximum extent permitted by law, OnCall will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, lost profits, lost data, lost opportunities, or conduct of other users. OnCall’s aggregate liability arising from the Service will not exceed the greater of amounts you paid directly to OnCall during the six months before the event giving rise to the claim or 100 US dollars. These limitations do not apply where prohibited by law.
12. Indemnity
To the extent permitted by law, you agree to defend and indemnify OnCall from third-party claims arising from your content, conduct, work relationship, legal violations, or breach of these Terms. This provision does not require indemnification for OnCall’s own unlawful conduct.
13. Changes
We may update these Terms. Material changes will be posted with a new effective date and additional notice when required. Continued use after changes take effect constitutes acceptance, except where law requires another form of consent.
14. Governing law
These Terms are governed by California law, without regard to conflict-of-law rules, except where the law of your residence requires otherwise. Before filing a dispute, contact admin@useoncall.com so the parties can attempt an informal resolution. These Terms do not limit rights that cannot legally be waived.
